Terms of Service

JOINTS Spearfishing
Tahiti, French Polynesia
Last updated: October 13, 2026

1. Overview

This website is operated by JOINTS Spearfishing, based in Tahiti, French Polynesia.

Throughout these Terms of Service, "JOINTS Spearfishing," "we," "us," and "our" refer to the business operating this website.

By accessing our website or placing an order, you agree to these Terms of Service, subject to any mandatory consumer rights applicable to your purchase.

These terms govern the sale of our custom-made spearguns and knives, wetsuits, fins, accessories, apparel and other products.

We may update these terms from time to time. Changes will be published on our website and will not retroactively remove rights relating to orders already placed.

2. Products and Specifications

We aim to provide accurate product descriptions, specifications, photographs and prices.

Handcrafted products may have minor variations in appearance, dimensions, grain, color or finish due to the manufacturing process.

Such variations do not exclude any rights relating to goods that fail to conform to their agreed specifications, descriptions or applicable legal requirements.

Customers should carefully review product specifications, sizes and compatibility before purchasing.

Product availability may change. If we cannot fulfill an accepted order, we will contact the customer and provide the refund or other remedy required by applicable law.

3. Orders and Payment

Customers must provide accurate billing, shipping and contact information.

Orders are subject to payment authorization, availability and acceptance.

Prices and shipping charges are displayed during checkout.

We reserve the right to reject orders for legitimate reasons, including suspected fraud, legal restrictions or product unavailability, subject to applicable law.

If payment has already been collected for an order we cannot fulfill, we will provide an appropriate refund.

4. Custom-Made Spearguns and Knives

JOINTS Spearfishing manufactures certain spearguns and knives to individual customer specifications.

Customers are responsible for reviewing and approving their requested specifications before production begins.

Once production has begun, custom-made orders cannot be voluntarily cancelled, returned or exchanged due to a change of mind, where the applicable legal exception permits this restriction.

This provision applies only to products genuinely manufactured or personalized to the customer's individual specifications.

It does not exclude mandatory rights relating to defective, incorrect or nonconforming products.

5. Shipping and Fulfillment

Orders may be dispatched from our facilities in French Polynesia or from authorized international fulfillment partners, including facilities in China and Italy.

Shipping availability, estimated delivery times and costs depend on the product, destination and shipping method.

Production and delivery estimates are provided in good faith but may be affected by manufacturing schedules, customs clearance, carrier operations and other circumstances.

Customers retain any mandatory rights concerning delivery deadlines, lost shipments, delayed delivery and cancellation.

Further information is available in our Shipping Policy.

6. International Orders, Customs and Duties

International shipments may be subject to import duties, customs charges, local taxes or clearance fees.

Unless expressly stated otherwise during checkout, these charges may be payable by the recipient, subject to applicable law.

Customers should review import restrictions and requirements in their destination country.

JOINTS Spearfishing will provide accurate customs documentation and comply with applicable export obligations.

Customers are responsible for ensuring that products can legally be imported, possessed and used in their destination, except where applicable law places responsibility on the seller.

7. Returns, Refunds and Cancellations

Our Return and Refund Policy governs voluntary returns, cancellations and refund procedures, together with any mandatory consumer rights.

For eligible standard products, customers may exercise applicable withdrawal or return rights within the legally required period.

For ordinary change-of-mind returns, customers are responsible for the direct cost of return shipping where permitted by law and disclosed before purchase.

Returned goods must be sent to the authorized return or fulfillment center designated by JOINTS Spearfishing. This will normally be the center that originally dispatched the order.

Return locations may be outside the customer's country, including China, Italy or French Polynesia. International return shipping may be expensive.

Customers must contact us for return instructions before dispatching goods.

No voluntary change-of-mind returns are accepted for genuinely custom-made spearguns and knives once production has begun, where permitted by applicable law.

These conditions do not limit statutory rights concerning defective, incorrect or nonconforming goods.

8. Product Warranties and Legal Guarantees

All products sold by JOINTS Spearfishing are subject to mandatory statutory consumer guarantees applicable to the purchase.

JOINTS Spearfishing does not provide an additional general commercial warranty on all products unless expressly stated.

Certain products may have a separate commercial warranty offered by JOINTS Spearfishing or the manufacturer. Any such warranty will be identified in the product description or accompanying warranty documentation.

JOINTS custom-made spearguns include a three-year limited commercial warranty against delamination and warpage under normal use, subject to our published Warranty Policy.

Commercial warranties are additional to, and do not replace or restrict, mandatory statutory consumer rights.

9. Normal Wear and Tear

Spearfishing equipment is used in demanding marine environments and is exposed to saltwater, sunlight, abrasion, repeated movement and physical stress.

Normal wear and tear, expected material aging, accidental damage, improper handling, inadequate maintenance and misuse are not automatically manufacturing defects.

Examples of normal wear may include neoprene compression, abrasion-related stitching wear, cosmetic scratches, fading and deterioration of consumable components through use.

The age of a product or frequency of use does not, by itself, determine whether a product is defective.

Premature failure caused by defective materials, workmanship or inadequate durability may constitute nonconformity under applicable law.

Claims will be evaluated according to the product's intended purpose, reasonably expected durability, condition, usage history, available evidence and applicable legal requirements.

Nothing in this section restricts statutory consumer guarantees.

10. Warranty Claims and Product Defects

Customers who believe a product is defective or nonconforming should contact:

info@joints-spearfishing.com

Please include the order number, a description of the issue and photographs or video where reasonably available.

JOINTS Spearfishing may request additional information or inspection where reasonably necessary to assess the claim.

Where a legal guarantee applies, the customer will receive the repair, replacement, refund, price reduction or other remedy required by applicable law.

JOINTS Spearfishing will bear costs associated with mandatory legal remedies where required by law.

Further details are available in our Warranty Policy.

11. Product Safety and Responsible Use

Spearguns, knives and other spearfishing equipment may cause serious injury or death if used improperly.

Customers must follow relevant safety instructions, use equipment responsibly and comply with applicable laws.

Products should be inspected before use and maintained according to the manufacturer's recommendations.

Customers must not use products for unlawful purposes.

Nothing in these terms excludes liability that cannot lawfully be excluded.

12. Intellectual Property

The JOINTS Spearfishing name, logos, original product designs, photographs, website text and other proprietary content are protected by applicable intellectual property laws.

Unauthorized commercial reproduction or distribution is prohibited unless permitted by law or authorized in writing.

13. Website Use

Customers agree not to use our website for fraudulent or unlawful activities.

Users must not interfere with the website's security, payment systems or functionality.

We may restrict access where reasonably necessary to prevent misuse, subject to applicable law.

14. Third-Party Services

Our website uses third-party services, including Shopify, payment processors, shipping carriers and fulfillment partners.

These providers may have their own terms and privacy policies.

JOINTS Spearfishing remains responsible for its obligations to customers under applicable law.

15. Limitation of Liability

To the extent permitted by applicable law, JOINTS Spearfishing is not responsible for losses that are not legally recoverable.

Nothing in these Terms of Service excludes or limits liability for fraud, intentional misconduct, personal injury where such limitation is prohibited, defective products, or any other liability that cannot lawfully be excluded.

Mandatory consumer rights remain unaffected.

16. Privacy and Personal Information

We process personal information in accordance with our published Privacy Policy.

Information necessary to process and deliver orders may be shared with payment processors, carriers and fulfillment partners, subject to applicable data protection requirements.

17. Governing Law and Disputes

These Terms of Service are governed by the laws applicable to JOINTS Spearfishing in French Polynesia, except where mandatory consumer protection provisions require otherwise.

Any dispute will be handled by the courts or dispute resolution bodies having jurisdiction under applicable law.

Nothing in this section removes mandatory jurisdictional or consumer rights available to customers.

Customers are encouraged to contact us first to seek an appropriate resolution.
